Terms of Use

These Terms govern the use of biancakato.com and the relationship between you (the user) and Bianca Kato Art. By browsing the website or requesting our services, you agree to the conditions below.

1. Acceptance of the terms

By accessing this website or booking services through it, you declare that you have read, understood and fully accepted these Terms of Use and the Privacy Policy. If you do not agree, please do not use the website or our services.

2. About Bianca Kato Art

Bianca Kato is a tattoo and visual artist, working professionally since 2017, with studios and appointments in São José dos Campos/SP and São Paulo/SP, Brazil, and on pre-scheduled travel dates. The services provided include:

  • Tattoo cover-ups;
  • Original mini tattoos;
  • Original canvas paintings;
  • Live painting at weddings and events;
  • One-to-one mentorship for tattoo artists.

3. Minimum age

Bianca Kato’s tattoo services are provided exclusively to people aged 18 and over, in line with the ethical and health guidance in force in Brazil. Proof of age may be requested before the session through official photo ID. Requests made by third parties, including family members, do not authorise tattooing minors.

4. How booking works

4.1. First contact

You can reach out through the website form, WhatsApp or Instagram. The information you send is reviewed individually and Bianca will get back to you within 2 business days with an initial assessment.

4.2. Quote

Every quote is personalised and takes into account size, complexity, colours, session length, travel (where applicable) and the specifics of the project. Prices given verbally, on social media or in first conversations are estimates and only become final once confirmed in writing.

4.3. Booking a date

A date is only confirmed once a deposit has been paid, in the amount and form agreed (usually between 20% and 50% of the total). The deposit:

  • Is deducted from the final price on the day of the session;
  • Is non-refundable if the client cancels, but may be moved once to another date with at least 7 days’ notice;
  • Is fully refunded or rescheduled at no cost if the cancellation or postponement comes from Bianca Kato (force majeure, health, schedule or logistics).

5. Client commitments

To ensure the best possible work and your safety, by booking you agree to:

  • Provide truthful information about your health, allergies, pregnancy, medication and skin conditions;
  • Arrive in good physical condition, having eaten and hydrated, and not under the influence of alcohol or other substances;
  • Not get tattooed while feverish, with an active infection, recovering from recent surgery or in other contraindicated conditions;
  • Fully follow the pre- and post-tattoo care instructions provided by Bianca;
  • Give at least 7 days’ notice if you need to reschedule.

6. Bianca Kato’s commitments

  • Carrying out the work with proper technique, single-use materials, sterilised equipment and appropriate hygiene standards;
  • Conducting appointments with attentive listening, respect and privacy;
  • Assessing in advance whether the requested artwork is feasible and pointing out technical limits when they exist;
  • Offering a free touch-up, under the conditions in section 8, when the result falls short for technical reasons.

7. Copyright and image rights

All artwork created by Bianca Kato is an original work, protected by Brazilian Law no. 9.610/1998 (Copyright Law). You acquire the right to wear the tattoo on your body, but you do not acquire the economic rights over the design, which remain with the artist.

This means that:

  • The artwork may not be copied, replicated, sold or used commercially by third parties without authorisation;
  • Bianca may reproduce the artwork in other media (portfolio, exhibitions, social media, books, promotional materials);
  • Photos of the tattoo may be used in the professional portfolio without personal identification. If you would rather your tattoo was not published, just let us know (see the Privacy Policy).

8. Touch-ups and guarantee

Bianca offers one free touch-up per tattoo, to be booked within 90 days of the session, subject to:

  • Evidence that the aftercare instructions were correctly followed;
  • A localised healing issue not caused by external factors (sun, sea water, swimming pools, intense exercise, scratching, friction, poor hygiene, or a pre-existing allergy that was not disclosed).

Tattoos in high-friction areas (hands, feet, fingers, lips), very sensitive skin, tanned skin or skin with a previous cover-up may require more sessions. This is explained and agreed before the work starts, and may involve an additional charge.

9. Cancellations, refunds and delays

  • Arriving more than 30 minutes late without notice may lead to rescheduling and loss of the deposit;
  • Cancellations with less than 48 hours’ notice mean the deposit is lost;
  • Where there is proven impossibility (health, bereavement, force majeure), we will consider rescheduling at no extra cost;
  • Refunds of amounts paid beyond the deposit follow art. 49 of the Brazilian Consumer Protection Code for contracts made at a distance.

10. Mentorship, paintings and live painting

For mentorships, original paintings and live painting at events, the specific conditions (schedule, deliverables, deadlines, number of hours, travel) are set out in a contract or in written messages before the work begins. The general clauses of these Terms (deposit, intellectual property, cancellation, image rights) also apply.

11. Use of the website

You agree to use this website lawfully and respectfully, and not to:

  • Attempt to access restricted areas, databases or source code without authorisation;
  • Send offensive, illegal, defamatory or discriminatory content, or content that infringes third-party rights;
  • Use the website for spam, unauthorised marketing, scraping or abusive automation;
  • Reproduce images, texts, photos or the visual identity of Bianca Kato Art without prior authorisation.

12. Limitation of liability

Bianca Kato makes every effort to keep the website available, up to date and free of errors, but does not guarantee uninterrupted operation or the complete absence of technical faults. We are not liable for:

  • Temporary unavailability caused by maintenance or third-party providers;
  • Content on external websites linked from ours;
  • Allergic or scarring reactions resulting from incomplete or untrue information provided by the client;
  • Indirect losses arising from improper use of the website or breach of these Terms.

13. Changes

These Terms may be updated at any time. The version in force is always the one published on this page, with the update date visible at the top. Continued use of the website after an update means you accept the new version.

14. Governing law and jurisdiction

These Terms are governed by Brazilian law, in particular the Consumer Protection Code (Law no. 8.078/1990), the General Data Protection Law (Law no. 13.709/2018) and the Copyright Law (Law no. 9.610/1998). The courts of São José dos Campos/SP, Brazil, are elected to settle any disputes, except where consumer jurisdiction rules expressly apply.
